National Advisory Council on Indian Education

The establishment of the National Advisory Council on Indian Education (NACIE) was one of the major provisions of the Indian Education Act of 1972, Pub. L. No. 92-318, 86 Stat. 235. NACIE consists of fifteen members who are appointed by the President and who must be American Indians or Alaska Natives.

Among its duties, NACIE is to advise the Secretary of Education with respect to the administration of and funding for all American Indian and Alaska Native education programs. NACIE must submit an annual report to Congress on its activities, including any recommendations for the improvement of Indian education programs and their funding. The Indian Education Act of 1972 is part of the Elementary and Secondary Education Act (ESEA) of 1965, Pub. L. No. 89-10, 79 Stat. 27. Successive reauthorizations of the ESEA have retained the provisions establishing NACIE; they are currently codified at 20 U.S.C. 7471.

NACIE produced annual reports from 1973 to 1993; however, beginning in fiscal year 1994 and continuing to fiscal year 2004, congressional appropriations for NACIE were eliminated or so drastically reduced that preparation of the required annual report to Congress was impossible.
