RESOLUTION NO. 99 - 19


Appointment of Ad Hoc Judges to the Coushatta Tribal Court

WHEREAS, the Coushatta Tribe of Louisiana ("the tribe") is a sovereign Indian Nation and is recognized as such by the United States of America; and

WHEREAS, the Coushatta Tribe of Louisiana is empowered by its sovereign state to exercise its Legislative, Executive and Judicial powers; and

WHEREAS, the Coushatta Tribal Council is duly elected governing body of the Coushatta Tribe of Louisiana; and

WHEREAS, the Coushatta Tribe of Louisiana established the Coushatta Court and Coushatta Court of Appeals pursuant to Coushatta Tribe of Louisiana Judicial Code, Title 1, Chapter 1, Section 1, and Chapter 2, Section 1; and

WHEREAS, an inherent part of judicial powers is providing for a court system an qualified persons to fill positions as Ad Hoc Judges for the trial court and appellate court when the need arises; and

WHEREAS, the Coushatta Tribal Council as the authority to appoint Special Judges on a temporary basis on such terms and conditions as the tribal Council shall establish in making appointment pursuant to Coushatta Tribe of Louisiana Judicial Code, Title 1, Chapter 3, Section 2; and

WHEREAS, the position of Ad Hoc Judge was publicly announced and applications were accepted and qualified candidates were interviewed by the Chief Judge, a member of the Coushatta Tribal Council and the Coushatta Tribal Administrator;

NOW, THEREFORE, BE IT RESOLVED, that the Coushatta Tribal Council hereby appoints the below named persons to serve as Ad Hoc Judges for a term of one (1) year, which may be extended by the Tribal Council, after the first year. The persons appointed will only be allowed to preside over those types of cases for which they have been approved by this resolution. The categories of appointment shall be Category 1 - Civil Infraction Judges, Category 2 - Trial Judges and Category 3 - Appeals Judges. A judges appointed to a specific category will be allowed to preside over cases in his/her category and lower number categories. The below named persons are hereby appointed as follows:

2) RANDY G. LEE

 

CATEGORY II

1) CRAIG RAY HILL
2) MARY HEBERT HOLMES
3) DANIEL STRETCHER, SR

CATEGORY III

1) DAVID EMILE MARCANTEL

2) HON. JOHN P. NAVARRE


BE IT FURTHER RESOLVED, that the Chief Judge shall have the authority to negotiate compensation with Ad Hoc Judges for any training, special projects, conferences or any other assignments other than deciding cases for the Coushatta Tribal Court separately and without regard to the above stated hourly rates.
