SUMMARY: This document announces the date and location of a Tribal hearing wherein EPA will take comments on its proposed rule for "Participation by Disadvantaged Business Enterprises in Procurement under Environmental Protection Agency (EPA) Financial Assistance Agreements," published on July 24, 2003, at 68 FR 43824. This Tribal hearing will be held during the 180 day public comment period for the proposed rule, which ends on January 20, 2004. EPA will publish information concerning additional public hearings and Tribal hearings during the comment period when that information becomes available.

SUMMARY: Under section 11 of the Indian Gaming Regulatory Act of 1988 (IGRA) Public Law 100-497, 25 U.S.C. 2710, the Secretary of the Interior shall publish in the Federal Register, notice of the approved Tribal-State compacts for the purpose of engaging in Class III gaming activities on Indian lands. The Principal Deputy Assistant Secretary--Indian Affairs, Department of the Interior, through her delegated authority, has approved the Tribal-State Compacts between the Santa Ysabel Band of Diegueno Mission Indians and the La Posta Band of Mission Indians and the State of California. The Compacts authorize a 350 machine Gaming Facility on the tribes' existing reservations, requires a 5% payment of net win from the operation of gaming devices to the State for the exclusive right to operate Class III gaming devices in the State of California, and as part of the Tribes' commitment to mitigate any significant, adverse impacts resulting from the casino development, the Tribes and the State, through San Diego County, have agreed to conclude one or more written agreements. All such agreements shall be concluded prior to the commencement of the Project, and shall provide for the identification and implementation of feasible mitigation measures and feasible project alternatives concerning problem and pathological gambling and significant environmental effects.

SUMMARY: The Tribal Solid Waste Interagency Workgroup (Workgroup) is soliciting proposals for its sixth year of the Tribal Open Dump Cleanup Project (Cleanup Project). Since FY99, the Workgroup has funded approximately $9 million in projects. In FY03, the Interagency Workgroup made approximately $2.1 million available to fully or partially fund 26 selected projects. A similar amount of funding is projected for FY04. The Cleanup Project is part of a federal effort to help tribes comprehensively address their solid waste needs. The purpose of the Cleanup Project is to assist with closing or upgrading tribal high-threat waste disposal sites and providing alternative disposal and integrated solid waste management.

SUMMARY: The Bureau of Indian Affairs is publishing the current list of Designated Tribal Agents for service of notice, including the listings of designated tribal agents received by the Secretary of the Interior prior to the date of this publication.

The regulations implementing the Indian Child Welfare Act (ICWA) provide that Indian tribes may designate an agent other than the tribal chairman for service of notice proceedings under the Act, 25 CFR 23.12. The Secretary of the Interior shall publish in the Federal Register on an annual basis the names and addresses of the designated agents.

SUMMARY: We are issuing a rule requiring that we immediately distribute $25 million of fiscal year 2004 Indian Reservation Roads (IRR) funds to projects on or near Indian reservations using the relative need formula. This partial distribution reflects the funds the Federal Highway Administration has allocated to the Department of the Interior and is based on funding appropriated by a continuing resolution and the Surface Transportation Extension Act of 2003 in effect until February 29, 2004. We are using the Federal Highway Administration (FHWA) Price Trends report for the relative need formula distribution process, with appropriate modifications to address non- reporting States. This distribution will allow an immediate allocation of funds based on an existing formula, final allocations will be dependent on a final authorization of highway trust funds and a fiscal year 2004 appropriations.

SUMMARY: This NOFA is issued in connection with two annual funding rounds of the NACA Program, one using FY 2003 and FY 2004 appropriated funds ("Round One") and one using FY 2004 and FY 2005 appropriated funds ("Round Two"), if appropriated funds are available. Through the NACA Program and subject to appropriation of funding for the purposes enumerated in this NOFA, the Community Development Financial Institutions Fund (the "Fund") will provide Financial Assistance ("FA") awards and/or Technical Assistance ("TA") grants to community development financial institutions ("CDFIs") that primarily serve Native American, Alaska Native and/or Native Hawaiian communities (hereafter referred to as "Native American CDFIs," serving "Native American Communities"). SUMMARY: This rule issues as final, and responds to public comments on, an interim rule published on June 13, 2002, to implement procedures and requirements for two new programs to address the housing needs of Native Hawaiians. The Native Hawaiian Housing Block Grant program will provide housing block grants to fund affordable housing activities. The Section 184A Loan Guarantees for Native Hawaiian Housing program will provide Native Hawaiian families with greater access to private mortgage resources by guaranteeing loans for one-to four-family housing located on Hawaiian Home Lands.

The general permits are grouped geographically by State, with the permit coverage being for specified Indian reservations in the State; any land held in trust by the United States for an Indian tribe; and any other areas which are Indian country within the meaning of 18 U.S.C. 1151. These general permits will replace the twenty-one general permits that were issued for a 5-year term in 1998 for Indian reservations in MT, ND, SD, and UT.

SUMMARY: EPA is announcing the meeting of the Forum on State and Tribal Toxics Action (FOSTTA) to collaborate on environmental protection and toxic chemical issues. This fractionation is due to the system of allotments established by the General Allotment Act of 1887. The President's fiscal year (FY) 2004 Budget incorporates a request for a significant increase for the Indian Land Consolidation program aimed at reducing the number of individual owners in parcels of Indian lands allotted to individuals. The Department has been actively working with tribal groups on the issue and will therefore not be convening a new working group.

SUMMARY: Notice is hereby given that the Office of the Special Trustee for American Indians (OST) will conduct consultation meetings to obtain oral and written comments concerning potential issues related to participation by OST in the Department of the Interior plan to consolidate agency appraisal functions. On June 19, 2003, Secretary of the Interior Gale Norton announced that real estate appraisal functions currently performed by various agencies within the Department would be consolidated by September 30, 2003, in a single office. This action is taken in response to concerns about the objectivity and management of appraisal functions carried out by several agencies within the Department, and documented in reports issued by the Department's Inspector General, the General Accounting Office and other groups. The goals of a consolidated appraisal organization include: to restore public and consumer confidence in land valuations; to ensure greater appraiser independence for unbiased valuation services that meet the highest professional standards; and a sharing of skills and resources throughout the Department. In addition, the consolidation is expected to provide better coordination and consistency of appraisal guidance, enhanced professional development of appraisers, and greater efficiencies in contract monitoring and development. Since July 2003, OST has participated in the Departmental action team composed of appraisal and realty specialists from affected offices within the Department. The action team has been meeting to determine the best way to accomplish the consolidation, with as minimal disruption to appraisal services as possible. Participation on this action team, and additional discussions with the Department, indicate that it would be in the best interest of the OST appraisal program to join this consolidation. Specific issues unique to the appraisal of Indian trust assets as conducted by the OST Office of Appraisal Services, and by self-governance and self-determination tribes, however, require special consideration. OST is planning tribal consultation meetings to discuss these issues.

SUMMARY: Pursuant to the National Environmental Policy Act of 1969, 42 U.S.C. 4332(C), the National Park Service (NPS) is preparing an Environmental Impact Statement for the Long Walk National Historic Trail Study, Arizona and New Mexico. This effort will result in a study that recommends to Congress whether the Long Walk of the Mescalero Apache and Navajo People should be designated a national historic trail. It will also propose alternative means of commemoration should it not be recommended for national historic trail designation. The plan will be developed in consultation with the Mescalero Apache Tribe, the Navajo Nation, the associated American Indian Tribes in the southwest, local communities along the routes of the Long Walk, other federal and state agencies and all other interested and affected organizations and individuals. The area involved includes but is not limited to: the Navajo Reservation in northeastern Arizona from the Grand Canyon area east to the New Mexico state line including Chinle and Window Rock, Arizona. The area in New Mexico includes but is not limited to: the vicinity of Gallup, Grants, Bosque Farms, Albuquerque, Santa Fe, Galisteo, Las Vegas, Fort Union National Monument, Anton Chico, Fort Sumner, and Mescalero, New Mexico. Alternatives to be considered include no-action, designation as a national historic trail, alternative means of commemoration other than national historic trail designation, and other ideas that come out of the public process.Major issues include: routes of the Long Walk, resources to be preserved along the route, whether the Mescalero Apache Tribe and the Navajo Nation are in favor of national historic trail designation, and how best to preserve and interpret the related events of that period.A scoping newsletter has been prepared that gives times, places, and dates of public meetings that will be held on the study. The Assistant Secretary--Indian Affairs, Department of the Interior, through her delegated authority, is publishing notice that the Second Amendment to the Gaming Compact of 1992 between the Ho-Chunk Nation and the State of Wisconsin executed on April 25, 2003 are considered approved. By the terms of IGRA, the Second Amendment to the Compacts are considered approved, but only to the extent that the Second Amendments are consistent with the provisions of IGRA. The Second Amendment expands the scope of gaming activities authorized under the Compact, removes limitations on wager limits, removes limitations on the number of permitted gaming devices, extends the terms of the compact to an indefinite term, subject to re-opener clauses, institutes an entirely new dispute resolution provision, replaces the sovereign immunity provision, and modifies the revenue-sharing provision of the Compact.

SUMMARY: We are issuing a temporary rule requiring that we distribute 75 percent of available fiscal year 2003 Indian Reservation Roads (IRR) Program funds to projects on or near Indian reservations using the relative need formula. As we did in fiscal years 2000, 2001 and 2002, we are using the Federal Highway Administration (FHWA) Price Trends report for information to calculate the relative need formula, with appropriate modifications to address non-reporting states. We will distribute the balance of the remaining 25 percent of fiscal year 2003 IRR Program funds according to the relative need formula.

We annually prescribe outside limits (frameworks) within which States may select hunting seasons. This proposed rule provides the regulatory schedule, announces the Flyway Council meetings, and describes proposed changes to the regulatory alternatives for the 2003-04 duck hunting seasons. We also request proposals from Indian tribes that wish to establish special migratory game bird hunting regulations on Federal Indian reservations and ceded lands. Migratory game bird hunting seasons provide hunting opportunities for recreation and sustenance; aid Federal, State, and tribal governments in the management of migratory game birds; and permit harvests at levels compatible with migratory game bird population status and habitat conditions.

As required by Section 1138 of the No Child Left Behind Act of 2001, representatives of tribal and tribally-controlled schools [Tribes with Bureau-funded schools] were invited to nominate tribal representatives to serve on the committee. After considering nominations, the Secretary proposes to appoint the persons named in this notice as tribal committee members. Tribes, tribal organizations, and individual tribal members may submit comments on the proposed tribal committee membership, apply for tribal membership on the committee, or submit other nominations for tribal membership on the committee. EPA will be the federal sponsor. The Tribal Conference will provide an opportunity for tribal leaders, tribal environmental managers, tribal organizations, federal agencies, and other interested entities/persons to share information about tribal environmental programs and discuss issues of vital interest to Indian country. The scope of the conference traditionally encompasses multi-media environmental issues involving tribes. The goals for the conference are to facilitate tribal environmental programs; establish stronger networks and relationships across environmental efforts in Indian country; identify shared lessons learned; and familiarize tribes with the full extent of tribal and EPA program environmental activities.
