The Tribal Court shall determine whether an elder or vulnerable adult is incapacitated and the degree of incapacity, and, where necessary, whether abuse or neglect has occurred. The determination shall be made only after petition, notice, hearing, and proof that is beyond a reasonable doubt.Lac Courte Oreilles Tribal Code of Law.
