FUEL REIMBURSEMENT FOR BATTLE MOUNTAIN TRIBAL MEMBERS

This section of the fuel Tax Ordinance shall not address any Tribal Tax, but pertains to adopted regulation File No. R046-91, Authority: NRS 365.110.

This regulation allows the Battle Mountain Band Council not to collect a fuel tax from tribal members enrolled under Battle Mountain Mountain Band on sales of motor vehicle fuel sold on the Battle Mountain Indian Colony.


Section 1. Implementing the Fuel Program for Battle Mountain Tribal Members

a. The following is set up for the purpose of exempt fuel tax status and that the Battle Mountain Indian Colony Smoke Shop/Convenience Store is the sole franchise to sell fuel.


Section 2. Receipts for Fuel Reimbursement

a. The Battle Mountain Band Council when applying for the Fuel Tax Refund shall be responsible for the following:

1. Must retain a receipt with every fuel purchase to include; Place of business on the Battle Mountain Indian Colony; Price per gallon; Dollar amount; Number of gallons; Date; Tribal enrollment number or sales tax exempt number; Signature of sales clerk and enrolled member of the Band.


Section 3. Responsibility of Tribal Member

a. When purchasing any motor vehicle fuel on the Battle Mountain Indian Colony, it is the Tribal Members responsibility to present his or her Tribal Enrollment Card to the sales clerk or cashier at all times. Done at time of sale only.

ORDINANCE NO. 93-ORD-TM-02


BE IT ENACTED BY THE TE-MOAK TRIBE OF WESTERN SHOSHONE INDIANS OF NEVADA, FOR AND ON BEHALF OF THE BATTLE MOUNTAIN BAND COUNCIL, AS FOLLOWS:

That in accordance with Article Constitution 4 Section 3(n) of the Constitution of the Te-Moak Tribe approved May 3, 1938, amended on August 26, 1982, as organized under the Indian Reorganization Act of June 18, 1934 (48 Stat.) as amended by the Act of June 15, 1935:
