TITLE VII - TRAFFIC SAFETY


Section 1. Application of Louisiana Highway Regulatory Act:

The provisions of the Louisiana Statutes identified below are hereby adopted as of this title. Any amendment to such provisions of the Louisiana Statutes shall be incorporated in this Title unless the Tribal Council shall provide otherwise. Nothing herein shall affect the authority of the Coushatta Tribal Council to amend, modify or repeal any provision of this Title, including provisions incorporated by reference from the Louisiana Statutes:

The Louisiana Highway Regulatory Act, Louisiana Revised Statutes, Title 32, Section 1, et seq. and Title 32, Section 1441, et seq.


Section 2. Penalties:

The penalties provided for in the Sections incorporated by reference from the Louisiana Statutes as provided in Section 1 shall be applicable in the enforcement of this Title except that no fine shall be imposed in excess of five hundred dollars ($500.00) and no jail term shall be imposed in excess of six (6) months. In addition to any other penalty imposed under this Title, the Court may prohibit any person convicted of an offense under this Title of operating any motor vehicle within the Reservation for a period not exceeding six (6) months.


Section 3. Driver's License and Vehicles:

No person shall operate a motor vehicle on any road within the Reservation or immediately adjacent to the Reservation, except the holder of a current and valid driver's license which entitles the holder to operate a motor vehicle on the public highways of the State of Louisiana and unless the vehicle is registered, licensed and equipped as required by Louisiana law.
