The Absentee Shawnee Tribal Housing Act shall define the requirements and responsibility of the Absentee Shawnee Housing Authority in this Act as follows:

(a) The Absentee Shawnee Housing Authority upon notification by any eligible participant is required and has the responsibility as defined in this Act at Chapter Two Section 202(a) and (b) or (c), to follow the mandate of this Act and provide at no cost to the participant a clear deed or title to the real property in which the individual currently resides;

(b) The eligible participant who currently resides in a home with the Absentee Shawnee Housing Authority as defined in Chapter Two Section 202(a), (d) and (e) shall have their home paid off under this Act and a clear deed or title issued to them by the Authority after having paid on the home for a total of fifteen years and no longer than fifteen years. The Authority shall go back though the years and calculate the date of move in by the participant and shall determined date of completion of fifteen years. When the participant has completed the fifteen years, under this Act they are to receive a free clear deed or clear title to the home;

(c) The Absentee Shawnee Housing Authority is required and has the responsibility, shall have no more than 90 days to complete the conveyance of the real property when notified by an eligible participant under this Act;

(d) The Absentee Shawnee Housing Authority, after conveying the real property shall retain the Monthly Equity Payment Account made over the Administrative Cost set by the Authority monthly which has accumulated and been set aside in the name of the participant during the participant's occupancy and residence at the real property under conveyance;

(e) The Absentee Shawnee Housing Authority shall provide for real property insurance for 90 ninety days after conveyance and the cost shall come out of the participant's equity. If there is no equity then the Authority shall absorb the cost;

(f) When the Authority is notified that the participant has met all legal requirements under this Act at Chapter Two Section 202(a), (b) and (c) to acquire clean title to the property all payments to the Authority shall cease immediately;

(g) It is the responsibility of the Authority to file the deed or title at the County Court House in the County where the real property is located.
