Chapter Three. Eligibility Requirements of Participants Under This Act

Eligibility for Elderly/Surviving Spouse

(a) It is the participant's responsibility to present the proof necessary to become eligible under this Act to the Absentee Shawnee Housing Authority;

(b) It shall be the responsibility of the participant or his/her surviving spouse under this Act to notify the Absentee Housing Authority when reaching the age requirement set for the elderly under this Act at Chapter Two, Section 202(a) and/or (b). This shall and can be accomplished by providing a letter from the Office of the Absentee Shawnee Tribal Secretary that states the date of birth and age of the enrolled member/participant. If the member has passed away the surviving spouse residing with the deceased Tribal member at the time of his/her death and having reached the age requirement and has continued to make payments on the residence will need to provide proof to the Absentee Shawnee Housing Authority of his/her age. This can be accomplished by submitting a letter from the Office of Tribal Secretary stating that their enrolled spouse is deceased and providing a driver's license, birth certificate, federal tax return etc. to the Absentee Shawnee Housing Authority to verify the age of the surviving spouse. Upon the completion of verifying the required age the surviving spouse shall be deemed qualified for his/her eligibility under this Act;

Disabled and Handicapped

(c) It shall be the responsibility of the participant under Chapter two, Section 202(a) and (c) under this Act to notify the Absentee Housing Authority that he/she has been determined disabled or handicapped either by the Social Security Administration or Veterans Affairs A letter from the Social Security Administration or Veterans Affairs showing that he/she is disabled or handicapped and are currently receiving a check for disability shall be sufficient evidence to qualify under this Act;

Eligibility for Enrolled Member

(d) It shall be the responsibility of the enrolled members who meet the qualification set forth in Chapter Two, Section 202(a) and (d) to provide to the Absentee Shawnee Housing Authority a letter from the Office of the Absentee Shawnee Tribal Secretary stating that he/she is a member of the Tribe and is not enrolled with another Tribe will be sufficient proof;

Conveyance and Monthly Equity Payment Account

(e) Upon receiving the conveyance of the real property from the Absentee Shawnee Housing Authority the participant shall forfeit to the Absentee Shawnee Housing Authority any Monthly Equity Payment Account that they may have accumulated while residing in the Absentee Shawnee Housing Authority house.
