Section 100. Citation

This Title may be cited as the Absentee Shawnee Housing Act for enrolled members and its Elderly, Disabled and Handicapped Tribal members of the Absentee Shawnee Tribe of Oklahoma.

AST HOUSING Act Section 101
Section 101. Declaration of Need and Legislative Findings

It is hereby declared and found:

(a) That the health, safety and welfare of the people of the Absentee Shawnee Tribe of Oklahoma are enhanced by continual encouragement, development, growth and expansion of services within the Indian country under the jurisdiction of the Absentee Shawnee Tribe of Oklahoma. That the Indian country under the jurisdiction of the Tribe is an economically depressed area that needs particular attention to enhance the quality of life for its enrolled members, including the elderly, disabled, handicapped enrolled members of the Tribe. The Executive Committee in order to address and improve the disproportionate and persistent rate which detrimentally affects these tribal members with their limited resources, has determined that through this Housing Act it shall and will address and improve their quality of life. It is therefore the purpose of this Act to stimulate and better the quality of life for these members under the jurisdiction of the Absentee Shawnee Tribe.

(b) That the jurisdictional area of the Absentee Shawnee Tribe of Oklahoma is an area of chronic and substantial economic underdevelopment, and there exists a critical need for a better quality of life for its disadvantaged members living within the jurisdiction of the Absentee Shawnee Tribe of Oklahoma.

(c) The Executive Committee having determined that a critical need exists to improve the quality of life for these disadvantaged members of the Tribe and wanting to focus its considerable energies and strengths by assisting with their limited resources, has decided that the most effective way to assist these members in alleviating these problems is through the Absentee Shawnee Housing Act.

(d) The United States Department of Housing and Urban Development on May 7, 1996 implemented notice PIH 96-25(IHA). This notice implements the provisions of Section 3004 of the Housing and Community Reconciliation Amendments of 1985, (the Amendments) P.L. 99-272 (April 7, 1986), which amends Section 4 of the United States Housing Act of 1937. The amendments authorized the Secretary of HUD to forgive outstanding principal and interest on loans made by the Secretary to Public Housing Agencies and Indian Housing Authorities (IHAs) and to cancel the terms of any contract with respect to repayment. With this notice all mutual help houses which the Absentee Shawnee Housing Authority had an obligation to reimburse HUD were forgiven.

(e) With the debt forgiveness extended from HUD to the Absentee Shawnee Housing Authority, the Executive Committee wanting to improve on a better quality of life for enrolled members, including it's elderly, disabled, handicapped enrolled members that live within the Housing Units of the Absentee Housing Authority shall extend this same notice and debt forgiveness in Section 101(d) to these members that are defined in Chapter Two, Section 202(a), (b), (c), (d) and (e) within this Housing Act.
