Ordinance 46 - An Ordinance Repealing All Prior Ordinances, Regardless Of Number Relating To Adoption Of Thirty Year Lease Regulations
WHEREAS, the Tulalip Tribes of Washington have misnumbered ordinances
and as a result thereof there has been confusion created in the records
of the Tulalip Tribes of Washington and the Bureau of Indian Affairs
regarding adoption of an ordinance establish 30 Year Lease regulations
pursuant to the Act of August 9, 1955 (69 stat. 539; 25 USC 415) and
it is the desire and the need of The Tulalip Tribes of Washington to
correct such numbering and the confusion related thereof;
NOW THEREFORE, BE, AND IT IS HEREBY ORDAINED that certain ordinance
regarding 30 Year lease regulations numbered 44-A purporting to repeal
Ordinance No. 44 and purporting to enact regulations prescribing procedures,
terms and conditions under which leases of tribal land may be granted
dated the 8th day of November, 1979, and all other ordinances, if any
there be, that have heretofore been enacted regarding 30- Year regulations
under and pursuant to the above referenced statute, be and same are
hereby repealed and of no further force and effect.
IT IS FURTHER ORDAINED that nothing herein contained shall be construed
to effect ordinances heretofore enacted regarding taxation which ordinances
are according to tribal number, ordinances numbered 43, 44 and the aforesaid
numbers 43 and 44 are revised in taxation in ordinance number 45.
IT IS FURTHER ORDAINED that the attached ordinance no. 47 being an ordinance
enacting regulations prescribing procedures, terms and conditions under
which leases of tribal land may be granted, shall be by the Executive
Director of the Tulalip Tribes of Washington, forthwith submitted to
the Superintendent of the Western Washington Indian Agency of the Bureau
of Indian Affairs for his information and transmittal to the Secretary
of the Interior for said ones final action for the reason that the authority
to approve the said Ordinance No. 47 is solely bested by law in the
Secretary of the Interior and such authority has not been administratively
transferred by him to either the Superintendent or the Area Office of
the Bureau of Indian Affairs.
ADOPTED by the Board of Directors of the Tulalip Tribes of Washington
at regular meeting assembled on the 10th day of May 1980, with a quorum
present by a vote of 6 for and 0 against.
