CHAPTER 28
HOUSING COURT ACT
28-01-01 TITLE
This law shall be known as the Sisseton-Wahpeton, Sioux Tribe Housing Court Act.
28-02-01 CREATION OF THE HOUSING COURT
There is hereby established the Housing Division of the Sisseton-Wahpeton Sioux
Tribal Court.
28-03-01 JURISDICTION
The Housing Division of the Sisseton-Wahpeton Sioux Tribal Court shall have
original jurisdiction over all civil landlord and tenant matters within the
jurisdiction of the court, and all civil matters where the Sisseton-Wahpeton
Sioux Tribe Housing Authority is a plaintiff or a defendant.
28-04-01 COMPOSITION OF THE HOUSING COURT
The Housing Division of the Sisseton-Wahpeton Sioux Tribal Court shall consist
of one Associate Judge who may be called for services by the Chief Judge when
occasion requires and who shall be compensated on a per diem basis.
28-05-01 ASSOCIATE JUDGE OF THE HOUSING COURT
Section 28-04-01 shall apply to the Associate Judge appointed to preside over
the Housing Division of the Sisseton-Wahpeton Sioux Tribal Court.
28-06-01 SEVERABILITY
If any clause, sentence, paragraph, section, or part of this code shall, for any
reason be adjudicated by any Court of competent jurisdiction, to be invalid or
unconstitutional, such judgement shall not affect, impair, or invalidate the
Judicial Approved remainder thereof, but shall be confined in its operation to
the clause, sentence, paragraph, section, or part thereof directly involved in
the controversy in which the judgement shall have been rendered.
