BUDGET PROCEDURES ORDINANCE

Siletz Tribal Code §4.01


§4.01 PURPOSE AND AUTHORITY.


The purpose of this ordinance is to provide a method to develop, adopt and modify the Tribal Council budget. The provisions of this ordinance apply to the expenditures of revenues from sale of tribal timber or other tribal enterprises by the Tribal Council or its representatives. It is not intended to apply to budgeting procedures related to federal, state or other governmental or private grant programs.


§4.02 BUDGET COMMITTEE.

There is hereby established a permanent Budget Committee consisting of the Tribal Chairman, Vice-Chairman, Chief Executive Officer and two tribal members at large. The Committee shall have responsibility for advising the Council on fiscal matters and for preparing a preliminary budget for submission to the Tribal Council as set forth below.


§4.03 INITIAL BUDGET DEVELOPMENT.

The tribal fiscal year shall be from January 1st of one year until December 31st of the following year. On or before the first day of June of every calendar year, the Chief Executive Officer shall notify all Tribal Council members, programs, committees and other interested parties of their right to submit proposals for the utilization of tribal timber revenues. Requests for timber revenues must be submitted in writing and include a detailed budget and justification for the utilization of funds. Requests for funds must be submitted to the Chief Executive Officer on or before September 1st of each calendar year.


§4.04 PRELIMINARY REPORT.

On or before October 1st of each year, the Budget Committee shall review the requests for funding and shall prepare a preliminary budget for Council review. At the regular Tribal Council meeting in October, the Chief Executive Officer shall present the preliminary budget together with a detailed justification for each line item submitted.


§4.05 COUNCIL REVIEW AND DELIBERATION.


The Tribal Council shall take the preliminary budget and recommendation under advisement. No later than the regular Council meeting in November, the Council shall adopt its final budget. If the Council fails to adopt a final budget, the previous fiscal year's budget shall be in effect until a new budget is adopted. During the time for consideration and deliberation, the Council may request further information and justification from the Chief Executive Officer and/or the Budget Committee regarding the recommendations. Each Council member is expected to have his or her individual questions answered on or before consideration and adoption of the budget.


§4.06 BASE BUDGET AND SPENDING GROWTH.


The final Tribal Council budget adopted for fiscal year 1987 shall be deemed the Council's base budget. The Council is authorized to change line items and modify the amounts in the existing line items but may not increase the total expenditures beyond 2-1/2 percent of the previous year's budget.

A fifth quarter (transition quarter) shall be established for the 1993 fiscal year. This quarter shall be from October 1, 1993 through December 31, 1993. This quarter of operation will be funded at 250 of the annual budget established for the 1993 fiscal year. For this quarter only the Council may appropriate supplemental funding for those programs with high activity during this quarter.


§4.07 MODIFICATION.


The Chief Executive Officer is authorized to modify the budget by redistribution of funds from one line item to another provided that no modification may reduce a line item by more than ten percent or exceed two percent of the total budget. Modifications in excess of the foregoing may be approved at the discretion of the Tribal Council upon submission of a timely request by the Chief Executive Officer together with such justification as he deems appropriate.


§4.08 SUPPLEMENTAL APPROPRIATIONS.


Additions to the budget may be approved by a majority of the entire Council, provided the supplemental appropriation does not raise the total budget above the ceiling established by Section 4.05. Requests for supplemental appropriations must be submitted by the Chief Executive Officer, together with a detailed justification for the request, on or before the regular Tribal Council meeting in October of each year. No supplemental appropriations may be approved by the Council after its October
meeting.


§4.09 CARRYING


Amounts not expended from line items may be carried into the next fiscal year. Carry in may be used within the same line item or redistributed to other line items pursuant to Section 4.07.


§4.10. EFFECTIVE DATE.


This ordinance shall become effective on February 21, 1987.


CERTIFICATION


The foregoing ordinance was amended by the Siletz Tribal Council at a Regular Council meeting held on May 15, 1993 at which a quorum was present, and the ordinance was amended by a vote of 8 FOR, 0 AGAINST, and 0 ABSTAINING.
