§5 LIMITATION OF ACTIONS

§5-1-1 Civil

(a) All civil actions must be commenced within one (1) year from the date of act or omission which is the subject of the complaint or petition, except that if the act or omission is not of such character as to immediately manifest itself then one (1) year from that date that a reasonably prudent person would have discovered said act or omission. Any civil action not brought within the time limitations set forth above shall be forever barred in the Tribal Court.

 

§5-1-2 Criminal

(a) All criminal actions must be brought within one year from the date the offense was committed. For purposes of determining whether the statute of limitations has expired on a criminal charge a criminal action shall be considered brought within the time period if the warrant of arrest has been issued within one (1) year from the date on which the offense was committed. Any criminal action not brought within the time period set forth above shall be forever barred in the Tribal Court.
