§ 101. Health Care Delivery Service Area

The Grand Traverse Band of Ottawa and Chippewa Indians hereby designates the five (5) county area of Leelanau, Antrim, Benzie, Grand Traverse, and Manistee counties as the service area for the delivery of health care services for Tribal members.

History: Tribal Act #81–010, enacted by Tribal Council on February 14, 1981.

COMMENT:

The Constitution adopted after enactment of Tribal Act #81–010 recognizes the addition of Charlevoix County to the tribal service area (Article I, Section 2, GTB Constitution). For health care delivery purposes, the following section includes Charlevoix County.

§ 102. Inclusion of Charlevoix County in Service Area

(a) The Grand Traverse Band of Ottawa and Chippewa Indians determines that Tribal members residing within Charlevoix County must be served by IHS program(s) on an equal basis with other members residing within the six-county service area designated in the Constitution of the Grand Traverse Band of Ottawa and Chippewa Indians approved by the Secretary of the Interior under the authority of the IRA; therefore commencing with the next IHS fiscal year, GTB staff are directed to provide IHS services to GTB members residing in Charlevoix County.

(b) The Indian Health Service shall be informed that the Grand Traverse Band is obligated to provide IHS-program services to Tribal members in Charlevoix County both by the IRA-approved Constitution and the Indian Civil Rights Act, 25 U.S.C. § 1302.

(c) The Indian Health Service is requested to provide additional funding in future fiscal years to account for the fact that the addition of Charlevoix County increases the GTB's service-area population.

§ 103. Establishment of Tribal Health Board

The Grand Traverse Band Tribal Council does hereby authorize the establishment of a Tribal Health Board. The authorizations under this Act remain in effect until rescinded or superseded.

§ 201. Authorization for Provision of Health Services

Legislative Background : The preamble to the following ordinance reads as follows:

Whereas the Grand Traverse Band of Ottawa and Chippewa Indians is a federally-recognized Tribe so proclaimed May 27, 1980 that retains its inherent right to self-government; and whereas the Tribal governing body had determined that it wishes to exercise the contract option; and whereas the Grand Traverse Band desires to continue to provide health services through a contract with the Indian Health Services; and whereas the scope of the contract is to plan, conduct, and administer the financial assistance for Comprehensive Health Services to include Community Health Representatives, Health Management, and Substance Abuse Services; and whereas the Tribal Chairman or his designee is authorized to negotiate and execute the contract and any amendments thereto; and whereas the authorities granted herein shall be effective until such time as the Tribal Governing Body takes further action by Resolution.

The Grand Traverse Band of Ottawa and Chippewa Indians Health Services shall be authorized to continue to provide health services.

§ 202. Limitation on Catastrophic Care Responsibility

The Grand Traverse Band of Ottawa and Chippewa Indians institutes the following policy effective April 1, 1990:

(a) That contract health service resources are insufficient to authorize payment for catastrophic services as defined by the Indian Health Service (I.H.S.) in excess of twenty thousand dollars ($20,000.00) per case. Vendors will be notified that funds are insufficient under the existing contract and that payment will not be authorized unless sufficient resources become available.

(b) Additional funds will be requested from IHS through the catastrophic health care fund on a case-by-case basis. Management of contract health care resources shall be in accordance with contract description specification, work statement C, paragraph 4, B (e) [1] and [2].

(c) Resolution [Tribal Act] #89–784 is rescinded.

Title 12. Infrastructure

GENERAL NOTES

Legislative Background : This Title was substantially amended by Tribal Act #06–24.1650 enacted by Tribal Council at Special Session on April 26, 2006. Said Act provided as follows:

.... that the GTB Department of Public Works be established to regulate the operation and maintenance of all Tribally-owned water and wastewater system.

Pursuant to the authority vested in the Grand Traverse Band Tribal Council by the Tribal Constitution, the Grand Traverse Band Tribal Council hereby establishes a public utility known as the GTB Department of Public Works and enacts this ordinance which shall establish the authority of the organization.

Said Act also provided for the repeal of former Chapters 1 and 2 of Title 12, as amended July 26, 2000; for the adoption of Chapters 1 through 8 as set forth below; and for the redesignation of former Chapter 3, Building Code, and Chapter 4, Roads, as Chapters 9 and 10.
