Elk Valley Rancheria Ordinance No. 00-22


AN ORDINANCE OF THE TRIBAL COUNCIL OF THE ELK VALLEY RANCHERIA ADOPTING THE UNIFORM CODES


Chapter 1 - Buildings and Construction


The Tribal Council for the Elk Valley Rancheria ("Tribe") hereby ordains as follows:


Section 1. Findings
:
The Tribal Council for the Tribe ("Tribal Council") finds and declares:

1. The County of Del Norte has no jurisdiction or authority to enforce its uniform codes regulating building and construction the Elk Valley Rancheria ("Reservation").

2. To ensure that buildings constructed on the Reservation are safe for human occupancy, the tribal Council needs to adopt codes establishing minimum standards for the construction of buildings and other structures on the Reservation.

3. The adoption of the Uniform Codes promotes the health and safety of all persons on the Reservation and is in the best interests of the Tribe.


Section 2. Adoption of Uniform Codes
. A new Chapter 1 is hereby added to the Elk Valley Tribal Codes which shall read as follows:

1.010 Definitions
. Whenever the following words and/or phrases are used in any of the Uniform Codes adopted in accordance with Section 1.020 below, they shall have the following meanings:

A. "Building inspector" or "Building official" shall mean a building official of the Elk Valley Rancheria.

B. "City" or "municipality" or "County" or "State" shall mean the Elk Valley Rancheria.

C. "Housing law" shall mean the housing law of the Elk Valley Rancheria.


1.020 Adoption of Uniform Codes by
Resolution. The Tribal Council may, from time to time, adopt by resolution the Uniform Administrative, Building, Building Standards, Electrical, Fire, Housing, Mechanical, Plumbing, and Dangerous Building Codes, as promulgated and updated from time to time by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials.


1.030 Retention
of Codes. Not less than one copy of each of the codes adopted pursuant to Section 1.020 above, all certified to be true copies by the Secretary of the Tribal Council for the Tribe, shall be filed and kept in the office of the Secretary of the Tribal Council and shall be available for public inspection during business hours while the codes remain in effect.


1.040 Sale of Copies
. The Secretary of the Tribal Council shall maintain a reasonable supply of copies of the codes adopted by this title available for purchase by the public at a price not to exceed the actual cost thereof to the Tribe. In lieu of keeping a reasonable number of the codes in supply for sale to the public, the Secretary of the Tribal Council shall have the authority to order copies of the codes for the public upon the payment of the actual cost of the codes to the Tribe, provided that the codes can be ordered and delivered to the purchaser within fourteen (14) days from the date of the request for the copies.


Section 3. Effective Date
. This Ordinance shall take effect immediately upon its adoption by the Tribal Council.

The foregoing Ordinance was adopted at a duly convened meeting of the Elk Valley Tribal Council on the 18th day of October, 2000, by the following vote:
