Laws of the Confederated Salish and Kootenai Tribes, Codified

Introduction
On December 9, 1999, the Tribal Council of the Confederated Salish and
Kootenai Tribes of the Flathead Reservation enacted Ordinance 103-A.
By that Ordinance the Tribal Council approved the partial revision of
Tribal law under a new system of codification entitled The Laws of the
Confederated Salish and Kootenai Tribes, Codified (CSKT Laws Codified).
In essence, the CSKT Laws Codified replaces The Law and Order Code of
the Confederated Salish and Kootenai Tribes of the Flathead Reservation,
Pablo, Montana and includes the codification of several recent Tribal
Ordinances.
Title I of the CSKT Laws Codified contains: Chapter 1. The Tribal Constitution
and Bylaws; and Chapter 2. The Courts (the revised codification of parts
of Ordinance 36-B formerly found in Chapters I and II of the Law and
Order Code, Ordinance 41 -A, and Ordinance 90-B).
Title II contains: Chapter 1. Tribal Offenses (the revised codification
of parts of Ordinance 36-B, formerly found in Chapter IV of the Law
and Order Code); Chapter 2. Criminal Procedure (the revised codification
of parts of Ordinance 36-B, formerly found in Chapter III of the Law
and Order Code) and Chapter 3. Probation and Parole.
Title III contains: Chapter 1. Domestic Relations (the recodification
of parts of Ordinance 36-B formerly found in Chapter V of the Law and
Order Code); Chapter 2. Children (the recodification of parts of Ordinance
36-B formerly found in Chapter VI of the Law and Order Code); Chapter
3. Youth (the codification of Ordinance 99); Chapter 4. Mental Health
(the codification of Ordinance 98); and Chapter 5. Adult Protection
(the codification of Ordinance 102-A).
Title IV contains: Chapter 1. Civil Actions, Limitations, and Liability
(the codification of Chapter 1 of Ordinance 97, as amended); Chapter
2. Civil Remedies (the codification of Chapter 2 of Ordinance 97, as
amended); Chapter 3. Civil Judgments (the codification of Chapter 3
of Ordinance 97, as amended); and Chapter 4. Small Claims (the codification
of Ordinance 91-A). Neither this Introduction nor the Tables of Contents
have been approved by Tribal Ordinance.
On January 27, 2000, the Tribal Council made a number of technical corrections,
found in Ordinance 103-A, Amendment #1. A list of revised code sections
can be found on the pages that immediately follow this Introduction.
On April 15, 2003, the Tribal Council of the Confederated Salish and Kootenai Tribes amended Tribal Ordinance 103-A to reflect needed typographical and technical corrections revising sections of the CSKT Laws Codified. The text of the amendment and the legislative draft of the code revisions are included in the Appendices and provide guidance as to which code sections have changed and the specific changes made.
