It is hereby declared and found:

(a) That the health, safety and welfare of the people of the Absentee Shawnee Tribe of Oklahoma are enhanced by continual encouragement, development, growth and expansion of services within the Indian country under the jurisdiction-of the Absentee Shawnee Tribe of Oklahoma. That the Indian country under the jurisdiction of the Tribe is an economically depressed area that needs particular attention to enhance the quality of life for its enrolled members, including the elderly, disabled, handicapped enrolled members of the Tribe. The Executive Committee in order to address and improve the disproportionate and persistent rate which detrimentally affects these tribal members with their limited resources, has determined that through this Act it shall and will address and improve their quality of life. It is, therefore, the purpose of this Act to stimulate and better the quality of life for these members under the jurisdiction of the Absentee Shawnee Tribe.

(b) That the jurisdictional area of the Absentee Shawnee Tribe of Oklahoma is an area of chronic and substantial economic underdevelopment, and there exists a critical need for a better quality of life for its disadvantaged members living within the jurisdiction of the Absentee Shawnee Tribe of Oklahoma.

(c) The Executive Committee having determined that a critical need exists to improve the quality of life for these disadvantaged members of the Tribe and wanting to focus its considerable energies and strengths by assisting with their limited resources.

AST HOUSING Act Section 502
Section 502. Purpose

The Absentee Shawnee Low Income Rental Units Act shall serve the purposes of:

(a) Remedying the lack of financial resources for enrolled tribal members, its elderly, disabled, handicapped enrolled Tribal members;

(b) To improve on the quality of life for enrolled tribal members, its elderly, disabled, handicapped enrolled Tribal members residing in the Absentee Shawnee Housing Authority low income housing rental units;

(c) This Act shall allow the enrolled members, its elderly, disabled, handicapped enrolled members to have more of their own resources that will assist then in the improvement of the quality of their life;

(d) This Act includes all current enrolled members that are participants who reside in low income rental housing units provided by the Absentee Shawnee Housing Authority and any future participants of enrolled members so residing;

(e) the participants of the low income housing rental units shall be deemed to be eligible for the Mutual Help and Occupancy Housing Program after residing in the low income housing rental unit six months after complying with and according to the low income housing unit lease agreement, after completion of the six month lease agreement period and if the participant wants to be a home buyer he/she shall be placed on the waiting list for the mutual help housing program;

(f) Having decided that the most effective way to assist these members in alleviating these problems with limited resources is through this Act and capping the rental cost of the low rental units.

(g) The Executive Committee hereby shall cap and set a total amount the Absentee Shawnee Housing Authority can collect from its enrolled tribal members, its elderly, disabled, handicapped enrolled Tribal members residing in the Absentee Shawnee Housing Authority low income housing rental units from the enrolled members and any future participants of enrolled members so residing in said units shall not exceed the limits set below as follows:

4-bedroom low rental housing unit is hereby set not exceed $200.00 per unit

3-bedroom low rental housing unit is hereby set not to exceed $175.00 per unit

2-bedroom low rental housing unit is hereby set not to exceed $150.00 per unit

I-bedroom low rental housing unit is hereby set not to exceed $125.00 per unit

AST HOUSING Act Section 503
Section 503. Definition

The Absentee Shawnee Low Income Housing Rental Act for the enrolled members, including the elderly, disabled, handicapped enrolled members of the Tribe shall define the eligibility of the participants that shall participate in this Act now and in the future:

(a) Eligible participant is defined and shall mean the participant must be 18 years of age or older and an enrolled member of the Absentee Shawnee Tribe of Oklahoma in order to be eligible under this Act and wants to reside in or currently is residing in an Absentee Shawnee Housing Authority Low Income Housing Unit;

(b) Elderly is defined and shall mean that any member who is enrolled with the Absentee Shawnee Tribe and has reached the retirement age of 62;

(c) Disabled and handicapped are defined and shall mean any member who is enrolled with the Absentee Shawnee Tribe who has been declared permanently disabled or handicapped by the state or federal government and is currently receiving a disability check either from the social Security Administration or Veterans' Affairs;

(d) Enrolled members are defined by the Constitution of the Absentee Shawnee Tribe and shall mean that the participant is currently enrolled with the Absentee Shawnee Tribe of Oklahoma and no other Tribe;

(e) Absentee Shawnee Housing Authority is defined and shall mean an agency founded by the Tribal government under State law which provides decent, safe and sanitary housing to the members of the Absentee Shawnee Tribe of Oklahoma;

(f) Low Income Housing Rental Unit is defined as a housing unit owned by the Absentee Shawnee Housing Authority for the sole purpose used as a rental housing unit for low income participants only;

(g) Mutual Help and Occupancy Housing Program is defined and shall mean a contractual agreement between the Authority and participant setting the terms and conditions for the participant to attain ownership of the real property belonging to the Authority.
