340:75-19-13. Qualified expert witness
(a) Persons likely to
meet the necessary qualification as an expert witness under the Federal
and State Indian Child Welfare Acts are:
(1) a member of the Indian
child's tribe who is recognized by the tribal community as knowledgeable
in tribal customs as they pertain to family organizations and child rearing
practices;
(2) a lay expert witness
having substantial experience in the delivery of child and family services
to Indians, and extensive knowledge of prevailing social and cultural
standards and child rearing practices within the Indian child's tribe;
and
(3) a professional person having substantial education and experience
in the area of his or her specialty.
(b) The court or any
party may request the assistance of the Indian child's tribe or the Bureau
of Indian Affairs agency serving the child's tribe in locating persons
qualified to serve as an expert witness.
