884.
OPENING SEALED RECORDS OF ADOPTIONS.
In addition to the exceptions noted in Section 16-1511, Idaho
Code, a sealed adoption proceedings may be opened in the
following circumstances according to the Indian Child Welfare Act: (3-20-04)
01. Motion Of An Indian Individual. Upon motion of an
Indian individual who has reached the age of eighteen (18)
and was the subject of an adoption, the court shall
provide tribal affiliation, if any, of the individual's biological parent(s)
and other information necessary to protect any rights flowing from
the individual's tribal relationship. (3-20-04)
02. Request From The Secretary Of The Interior Or The
Indian Child's Tribe. Upon request of the Secretary of the
Interior or the Indian child's tribe, evidence of efforts to
comply with the Indian Child Welfare Act shall be made
available
to the parties requesting such information. (3-20-04)
